Introduction

Welcome to SoundSurf. By accessing or using our website and services, you agree to be bound by these Terms of Service. Please read them carefully before making a purchase or subscribing to our services.

Vinyl Purchases

• Vinyl record sales are generally final, except in the cases described below.
• Returns of opened or unsealed items are not accepted, except for damaged or defective products.
• Refunds are issued where required by applicable consumer protection law or where the product is damaged, defective, or not as described.
• Pre-orders may be cancelled at any time before the item ships. Once shipped, our standard return policy applies.

Damaged or Defective Items

We make exceptions for items that arrive damaged or defective:

• Please contact us within 48 hours of delivery with photos so we can resolve the issue quickly. This does not affect your statutory rights.
• We will offer a replacement, refund, or store credit, in line with applicable consumer protection law.
• Wrong item shipped? Contact us for free return and replacement.
• Where possible, please retain the original packaging — it helps us process damage claims with the carrier.

Subscriptions (Pro & VIP)

• Subscription fees are generally non-refundable, except where required by applicable law.
• You may cancel your subscription at any time.
• After cancellation, access continues until the end of the billing period.
• Prorated refunds are not provided for early cancellation, except where required by applicable law.
• Subscriptions auto-renew unless cancelled before the renewal date.

User Accounts

• You must be at least 16 years old (or the age of digital consent in your country) to create an account.
• You are responsible for maintaining the security of your account.
• You must provide accurate and complete information.
• You are responsible for all activities under your account.
• We reserve the right to suspend or terminate accounts for violations.

Pricing and Payment

• All prices are displayed in the selected currency and include applicable taxes.
• Prices may change without notice. Once an order is placed, the price at the time of order is honoured.
• Payment is required at the time of purchase.
• We accept major credit cards and other payment methods as displayed.

Shipping

Shipping times and costs vary by location. We are not responsible for delays caused by shipping carriers or other circumstances beyond our control.

Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of SoundSurf or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Use of Third-Party Data

SoundSurf integrates data from third-party sources, including the Discogs API, to provide information about music releases, artists, tracklists, labels, community ratings, and related content. All use of third-party data is subject to the respective provider's terms of use.

Discogs Data

Scope of Data

SoundSurf uses the Discogs API to display release metadata, artist information, tracklists, label data, and community ratings. This includes:

• CC0 Data: Release titles, notes, dates, formats, tracklists, barcodes and other identifiers, credits, versions, URL links to third-party sites, artist names, notes and associated releases, and label/producer/manufacturer/distributor names, contact information, notes and associated releases. This data is made available by Discogs under the CC0 No Rights Reserved license.
• Restricted Data: Discogs Marketplace data (pricing, sales history, inventory) and individual Discogs user account data (usernames, profile information, avatars). SoundSurf does not use either category for any purpose, and does not transfer or redistribute any Restricted Data to third parties. Release, artist, and label images are addressed separately under "Album Artwork & Images" below.

Attribution & Trademark Notice

In accordance with Discogs API requirements, SoundSurf displays the following:

• "Data provided by Discogs" displayed next to Discogs data, with a hyperlink to the corresponding Discogs page.
• Trademark disclaimer: "This application uses Discogs' API but is not affiliated with, sponsored or endorsed by Discogs. 'Discogs' is a trademark of Zink Media, LLC."

Data Usage Compliance

• SoundSurf strives to keep Discogs data up to date, but data may occasionally differ from the current state on Discogs.
• Restricted Data is not resold, transferred to third parties, or used for purposes outside of the SoundSurf platform.
• Users must not extract, scrape, redistribute, or repurpose any Discogs data obtained through SoundSurf.

Album Artwork & Images

Release, artist, and label images from the Discogs catalogue are displayed under Fair Use, either (a) for the purpose of identifying physical products offered for resale under the First Sale Doctrine, or (b) for editorial and informational commentary about the music, artists, and labels shown, as permitted by the Discogs API Terms of Use. These images remain the property of their respective copyright owners. SoundSurf does not claim ownership of any artwork. If you believe an image infringes your copyright, please contact us at support@soundsurf.me.

User Responsibilities

• You agree not to attempt to circumvent API restrictions, scrape data from SoundSurf, or access Discogs data outside of the intended use of the platform.
• All pricing, marketplace, and community data are provided as-is for reference. SoundSurf is not responsible for inaccuracies in third-party data.

Third-Party Data Disclaimer

SoundSurf makes no representations or warranties regarding the accuracy, completeness, or legality of any third-party data. Users should independently verify information when making decisions based on Discogs data, including collection management or pricing considerations.

Limitation of Liability

To the extent permitted by law, SoundSurf shall not be liable for any indirect, incidental, or consequential damages that may arise from the use of our products or services.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These Terms are governed by the laws of Ukraine. Any dispute arising from these Terms will be resolved in the competent courts of Ukraine, except where mandatory consumer protection laws of your country of residence provide otherwise.
